TERMS & CONDITIONS

ORDERINGPROMOTIONAL PRODUCTS

1.       Orders must have a minimum value ofR1000 (branded items) or R500 (unbranded items) to qualify for the pricesreflected on this website. For orders less than this please contact us for aprice.

2.       All quotations are valid for a periodof 7 days from the date of the quotation and for international clients quotedprices exclude any local import duties and taxes.

3.       Work will only commence once the quoteas well as Terms & Conditions have been accepted by the Customer.

4.       ALM Marketing Designs cannot be heldresponsible for incorrect product selection.  The customer acknowledgesthat it is its sole responsibility to determine that the products ordered aresuitable or correct for the purposes of the intended use of the products by thecustomer and/or its customers.

5.       All quotations are subject to theavailability of products or services and are subject to any increases in thecost price for whatever reason to ALM Marketing Designs before acceptance ofthe order.

6.       The order is only accepted by ALMMarketing Designs once it has been confirmed in writing by the Customer. Payment of a deposit does not constitute acceptance of the Customer’s order.

7.       All quotes are subject to stockavailability at the time of confirming the order.  Stock changes on adaily basis and therefore stock availability cannot be guaranteed until adeposit has been paid and we have confirmed the order with our supplier.Payment of the 50% deposit does not infer acceptance of the order as ALMMarketing Designs can only confirm stock once the Customer has paid thedeposit.

8.       ALM Marketing Designs shall beentitled to reasonably refuse any order placed by the customer and shall underno circumstances be liable to the customer if for any reason ALM MarketingDesigns refuses to accept, fails to deliver and/or fails to deliver timeouslyany order or part thereof placed with ALM Marketing Designs by the customer.

9.       Lead times will be deemed to commenceon the date and time that ALM Marketing Designs receives in writing all signedoff approvals of the artwork and payment of the funds have been cleared.

RETURNS& REFUNDS OF PROMOTIONAL ITEMS

1.       No items will be returned orexchanged unless prior written authorization has been obtained from ALMMarketing Designs within 24 hours of delivery/collection and will be subject toa 25% handling and admin fee.

2.       It is the sole responsibility of thepurchaser to determine that the goods purchased are suitable for the purposesof intended use.

3.       ALM Marketing Designs will not acceptbranded or custom made goods for exchange.

4.       All non-faulty returns/exchanges willbe subject to a handling fee of 25% of the total amount of the invoice.

5.       Under no circumstances may goods bereturned to any of our physical addresses without prior written arrangement.

6.       Refunds will take up to 30 days onceaccepted.

7.       Goods returned will be eitherreplaced or a credit given at ALM Marketing Designs discretion

8.       No branded goods will be returnable

9.       ALM Marketing Designs cannot acceptreturns on incorrect items which have already been branded regardless ofwhether it’s ALM Marketing Designs fault or not.

10.     Once an order on memory sticks has been collected from us, ALM MarketingDesigns cannot accept a return on it.

11.     Once stock has been collected/delivered from/by ALM Marketing, we haveno control over it. As such we do not accept responsibility for any damages orshortages not reported within 24 hours.

SPECIALIMPORT PRODUCTS

1.       ALM Marketing cannot be heldresponsible for delays as a result of import procedures such as customs rightto inspect all incoming goods.

2.       No cancellations can be accepted oncean order has been faxed, emailed or a deposit has been received as no refundscan be given and the full amount will be payable.

3.       A 75% deposit is required for allorders that are a Special Import Item – there are no exceptions.

DELIVERY& COLLECTION OF PROMOTIONAL ITEMS

1.       Orders must be collected within 10workings days from the order being ready for collection (unless alternativearrangements have been made). Orders not collected within 10 working days willbe deemed to be cancelled and will be returned to stock or sold to offset ourcosts.

2.       At the customer’s request, ALMMarketing Designs will cause goods to be delivered to the customer via courier,which costs shall be debited to the customer and payable by the customer priorto delivery of the goods.

3.       Delivery times quoted are estimatesand are not binding on ALM Marketing until the job is in production.

4.       Delivery prices will be quoted on anindividual job basis.

5.       Any third party, other than thatappointed by ALM Marketing, engaged in transporting the goods shall be deemedto be the agent of the customer irrespective of which party gave instructionsto or paid such third party.

6.       Damaged or missing products need tobe advised in writing to ALM Marketing within 24 hours of receiving the goods.

7.       Goods delivered in damaged packaging,or the external box shows proof of being tampered with, needs to be indicatedon the delivery slip when signing for the delivery of the goods. This must beforwarded to ALM Marketing within 24 hours and if possible, a picture to beforwarded of the damaged packaging.

8.       If items have to be re-deliveredbecause they were refused, undeliverable or unclaimed due to incorrect addressdetails provided by the client, the client will be billed and held liable forany additional delivery costs.

9.       ALM Marketing shall be entitled inits sole discretion to split the delivery of the products ordered in thequantities and on the dates it decides.

VIEWINGOF SAMPLES

The Customer is solely responsiblefor determining that the goods purchased are suitable for the purposes theyintend to use it for. For this reason, we strongly recommend that the Customerviews or purchases samples.

1.       Return of samples is subject to thefollowing in order for a refund to be processed –

o   Samples must be returned in originalcondition as well as original undamaged packaging.

o   Damage to any part of samples orpackaging will result in samples not being accepted for return.

o   We do not take back returns of memorystick samples unless they are dummy samples

o   We do not take back returns of hampersamples

CANCELLATIONOF ORDER

1.       Written orders (faxed or by email)constitute a binding contract and are legally enforceable.

2.       Once an order has been received byALM Marketing and a deposit has been paid, cancellations for that order willonly be entertained if no branding has taken place and will be subject to a 25%handling and admin fee and R350-00 per layout if a layout was created.

3.       No cancellations of an order will beaccepted on any branded items, custom made items or specially imported items.

4.       Any order is subject to cancellationby ALM Marketing due to Acts beyond their control including but not limited to:inability to secure materials, supplies or power, riots, strikes, lockouts,labour disputes, civil disturbance, war, acts of God or fire.

5.       Orders that have been branded andpaid for and remain uncollected for 30 days will be given to charity.

ARTWORKFOR PROMOTIONAL BRANDED PRODUCTS

1.       Any delay in providing your artworkand/or receiving your artwork approval could affect the delivery date and wecannot be held responsible for this.

2.       Any changes requested to be made tothe artwork may also affect the delivery date.

3.       Branding cancelled after layouts havebeen generated will be charged for at R350.00 excl VAT per layout done.

4.       No work will commence until ALMMarketing Designs is in receipt of the duly completed signed off artwork. Anychanges required, we will issue a new layout for final proofing beforeproduction starts.

5.       In order to sign off the artwork, ALMMarketing will furnish the customer with an artwork approval via e-mail,illustrating the appearance of the artwork on the customers chosen product.This must be checked thoroughly by the customer in respect of, inter alia,spelling, fonts, colours (stipulate pantones if you require them and they arenot shown), sizes, etc. and signed off.

6.       Layouts sent in colour via email arenot a true reflection of the colour but a mere indication of what the productwill look like.

7.       Please note no approvals will beaccepted telephonically or without the signed off artwork.

8.       We will not be held responsible forany spelling or artwork errors once approved by you.

9.       Once artwork has been approved andplates/screens made, any changes thereafter will be charged accordingly.

10.     The customer understands that the branding of promotional products isnot always permanent and may wear off over time.

11.     Printing colours will be matched as close as possible to Pantone coloursor swatches supplied. We do not guarantee 100% colour match. We cannotguarantee 100% colour consistency on different materials.

PAYMENTFOR PROMOTIONAL PRODUCTS

1.       Payment:

o   All payments made by the customer toALM Marketing Designs shall be made free of deduction, set-off, bank charges orcommissions

o   A 50% deposit based on the invoicevalue is required on the placement of an order

o   A company Purchase Order may beaccepted at the sole discretion of management.

o   The remaining 50% of the invoicevalue must be paid when notice is given that the goods are either ready forpickup or that the goods are ready for delivery.

o   Goods will only be released once yourorder has been fully paid for.

o   Please note that Electronic FundsTransfer is our preferred method of payment.

o   Cash payments will incur a 1.75% cashhandling fee

o   Credit Card payments will incur a 4%processing fee

2.       Note that due to currencyfluctuations, we reserve the right to change prices without prior notificationwhether or not a quotation has been accepted and confirmed.

3.       Upfront orders will only be releasedonce proof of payment has been received and cleared in our Bank Account. ALMMarketing cannot be held responsible for missed deadlines if payment has notbeen received in time.

4.       All orders are treated as UpfrontPayment unless account facilities have been approved in writing.

5.       We reserve the right to withdraw oramend credit facilities at our discretion.

6.       The Customer has no right to withholdpayment for any reason whatsoever and agrees that any extension of time givenfor payment shall be valid only if reduced to writing and signed by bothparties.

7.       All discounts shall be forfeited ifpayment in full is not made on the due date.

8.       Goods remain the property of ALMMarketing until paid in full.  The risk in and to the products shall passfrom ALM Marketing to the customer upon the date of delivery thereof by ALMMarketing to the customer or their agent. Any delivery note or waybill (be it acopy or an original) signed by the customer or a third party engaged totransport the products shall be conclusive proof that delivery was made to thecustomer.

9.       Non-payment resulting inLegal/Collection fees being incurred will be for the clients’ account.

10.     ALM Marketing shall be entitled but not obliged to charge interestcalculated in arrears on any amount due to it by the Customer at a rate of 2%above the prime overdraft rate of our Bankers at the time of the monthlycalculation.

ALM Marketing and its affiliates attempt to be as accurate as possible.However, ALM Marketing does not warrant that product descriptions or othercontent on this site are accurate, complete, reliable, current, or error-free.If a product is not as described, your sole remedy is to return it in unusedcondition subject to the terms and conditions as outlined above. Please notethat any product which has been branded will not be accepted for return orrefund.
